§ 1 General
Participation in Labexchange – Die Laborgerätebörse GmbH competition at the analytica 2022 shall only be possible together with these conditions of participation.
§ 2 Prerequisites for Participation
1. All natural and legally competent persons aged 18 and above may participate. Employees of Labexchange Group and their relatives are excluded from participation.
2. The Participant is to fill in the entry form completely and correctly.
3. By participating, the Participant declares his/her agreement with the publication of his/her name and photograph on the Internet and in specialist publications in the event of a win.
4. Participation is only possible within the period stated on the entry form. The judge’s decision is final.
5. Participation is not dependent on placing an order.
6. Only persons who are proven to be involved in using analytical instrumentation are entitled to participate.
7. The completed entry form must be submitted in person to our exhibition stand, 207, Hall A2 by the person entered in the address field.
8. Only one entry form per person may be submitted.
9. Persons who, when asked to do so, are unable to prove that they are involved in using analytical instrumentation or who cannot prove their identity may be excluded from participation.
10. Labexchange can exclude certain persons from participation without giving any reason.
§ 3 Prize
1. The prize will be awarded once only, as announced.
2. The prize draw will take place after the tradefair at the head office of the Labexchange Group in Burladingen, Germany.
3. If, for any unforeseen reason, the prize draw cannot take place immediately after the fair, the draw will take place at a later date, notice of which will be given in due time.
4. The winner will be informed in writing.
5. A cash payment is not possible.
§ 4 Liability
1. Claims for compensation made against Labexchange – Die Laborgerätebörse GmbH in connection with this competition – to the extent permitted by law – are excluded, irrespective of their legal grounds, unless Labexchange was in breach of its legal obligations intentionally or due to gross negligence.
2. Furthermore, Labexchange is not liable for damage resulting from the impairment of availability of the competition website, technical breakdowns beyond its control or force majeure events, as well as attacks by third parties on the competition website.
§ 5 Saving Clause
Should any one of the stipulations of these conditions of participation be invalid or if there is a gap in the provisions of these conditions, this shall not affect the validity of the remaining stipulations. The invalid or missing stipulations shall be replaced by a stipulation which reflects as closely as possible the purpose of the agreement and the statutory regulations.
§ 6 Place of Jurisdiction / Applicable Law
1. German law shall apply exclusively in the event of a dispute. It is agreed that the place of jurisdiction, where legally permissible, shall be Hechingen.
2. Insofar as the Participant has no domestic place of general jurisdiction in Germany, or if he/she transfers his/her normal place of residence abroad subsequent to participation, it is agreed that the place of jurisdiction shall also be Hechingen.
